STANDARD TERMS AND CONDITIONS OF SALE (IoT Ni)
1. Agreement:
This document outlines the Standard Terms and Conditions of Sale for all products purchased from IoT Ni. By placing an order and making payment, you (the "Client") agree to be bound by these terms.
2. Orders and Payment:
All orders are subject to acceptance by IoT Ni. Full 100% advance payment is required at the time of placing the order. The order will not be processed or enter the fulfillment queue until full payment has been received and confirmed.
3. Shipping and Fulfillment:
3.1. Order Processing & Status: Product pages may not always specify if an item is 'In-Stock' or 'Pre-Order'. The fulfillment status will be determined after the order is placed.
3.2. Client Notification: The Client will be notified via WhatsApp within 24-72 hours of order confirmation whether their order will be shipped from available stock or has been placed on pre-order.
3.3. Shipping Timelines:
In-Stock Orders: If the item is in stock, it will be processed and shipped within 2-3 business days.
Pre-Orders: If the item is not in stock, it will be treated as a pre-order with an estimated shipping time of 2 to 4 weeks. This timeframe is an estimate and not a guarantee.
3.4. Delivery Estimates: Delivery timelines provided by IoT Ni are estimates and commence from the date of shipping, not the date of order.
4. Cancellations, Returns, and Refunds:
4.1. By Client (Cancellation): Once an order (including Pre-Orders) is placed and payment is made, it cannot be cancelled by the Client.
4.2. By Client (Returns): All products sold by IoT Ni are non-returnable.
4.3. By IoT Ni (Cancellation): IoT Ni reserves the right to cancel any order (including pre-orders) at its sole discretion for any reason (e.g., component unavailability, pricing error). In such an event, the Client will be notified, and a full refund of the received amount will be processed.
5. Limited Warranty (3 Months):
5.1. Coverage: Our products come with a 3-month limited warranty against manufacturing defects only, valid from the date of delivery.
5.2. Warranty Exclusions: This warranty is void and does not cover any damages or defects resulting from:
Improper installation, incorrect wiring, or connection to a non-specified voltage.
Water damage, liquid spillage, or exposure to excessive moisture.
Connecting a load that exceeds the device's specified capacity (Overload).
Physical damage, dropping, or misuse.
Any attempt to open, tamper with, repair, or modify the device's hardware or firmware.
5.3. Claim Process: To claim the warranty, the Client must contact IoT Ni with proof of purchase and evidence of the manufacturing defect.
6. Defective or Damaged Products (On Arrival):
In the event a product is received damaged in transit or 'Dead on Arrival' (DOA), the Client must contact IoT Ni via Email or WhatsApp within 3 days of receiving the product. We will assess the situation and provide a resolution (such as repair or replacement) at our discretion.
7. Client Responsibility and Liability:
The Client is solely responsible for reading and understanding the product specifications, user manual, and connection diagrams before use. IoT Ni is not liable for any damage to the product, or any other property, caused by improper use, incorrect voltage, faulty connections, or user error.
8. Product Appearance:
Product images on the website are for illustration purposes. The final product's appearance, color, or design may vary slightly from the images shown.
9. Governing Law and Jurisdiction:
All our contractual relations and disputes will be governed exclusively by Indian law. Any legal dispute or claim will be subject to the exclusive jurisdiction of the courts in Agartala, Tripura. :
10. Return and Warranty Shipping Policy
10.1. Inbound Shipping (Client to IoT Ni):
In the event that a product needs to be sent to IoT Ni for any reason (including warranty claims under Section 5 or DOA claims under Section 6), the Client is solely responsible for securely packing and shipping the product to IoT Ni's designated address at their own cost.
10.2. No Reverse Pickup:
IoT Ni is not obligated to arrange for a reverse pickup of the product from the Client. While IoT Ni may, at its sole discretion, choose to assist with pickup in certain cases, this is not a guarantee. The default responsibility to ship the product remains with the Client.
10.3. Outbound Shipping (IoT Ni to Client):
The Client is responsible for paying all shipping charges for the product to be returned from IoT Ni back to the Client. This policy applies to all repaired or replaced items, including those serviced under the 3-Month Limited Warranty.
10.4. Warranty Scope Clarification:
The Limited Warranty (Section 5) covers only the cost of repair or replacement of the defective parts. It explicitly does not cover any two-way shipping, freight, or transit charges. Product repair or dispatch from IoT Ni will only occur after the Client has paid the required outbound shipping fees.
11. Payment Failures and Disputes
In the event of a payment failure where money is debited from the Client's account but an order is not successfully placed or confirmed, the issue lies between the Client and the Payment Provider (e.g., Razorpay, or the Client's bank). IoT Ni is not liable for such failed transactions as we do not receive the funds. The Client should contact us via WhatsApp immediately with the transaction details. IoT Ni will provide reasonable assistance to help the Client facilitate communication with the payment provider to resolve the issue or process a refund.
12. Delivery Partner Liability
All shipping and delivery timelines provided by IoT Ni (as stated in Section 3) are estimates only and are not guaranteed. IoT Ni is not liable or responsible for any delays in delivery caused by our third-party shipping partners (e.g., Blue Dart, Shiprocket, etc.). Responsibility for delays due to logistical issues, technical problems, weather, or any other unforeseen circumstances lies entirely with the delivery partner.
13. Privacy Policy
By placing an order, the Client agrees that IoT Ni may store and use their personal information (such as name, address, email, and phone number) for the purpose of processing orders, providing customer support, and managing warranty claims. We respect your privacy and will not sell or rent this data to third parties.
14. Limitation of Liability
To the maximum extent permitted by law, the total liability of IoT Ni for any claim, whether in contract, warranty, or tort (including negligence), arising from any product or service, shall not exceed the purchase price paid by the Client for that specific product. IoT Ni is not liable for any indirect, special, incidental, or consequential damages (such as loss of profit, loss of data, or damage to other property).
15. Intellectual Property
All content on this website, including the "IoT Ni" name, logos, product designs, graphics, and the underlying software/firmware of our devices, is the exclusive intellectual property of IoT Ni. It is strictly prohibited to copy, reproduce, reverse-engineer, or distribute any of our intellectual property without our express written consent.
16. Force Majeure (Events Beyond Our Control)
IoT Ni shall not be held liable for any delay or failure in fulfilling its obligations (such as shipping delays) if such delay or failure is caused by events beyond our reasonable control. This includes, but is not limited to, acts of God (floods, earthquakes, fires), government actions (lockdowns, customs delays), wars, acts of terrorism, riots, or catastrophic failures of third-party infrastructure (such as shipping networks or component suppliers).
